The Valletta Treaty (formally the European Convention on the Protection of the Archaeological Heritage (Revised), also known as the Malta Convention) is a multilateral treaty of the Council of Europe. The 1992 treaty aims to protect the European archaeological heritage "as a source of European collective memory and as an instrument for historical and scientific study". All remains and objects and any other traces of humankind from past times are considered to be elements of the archaeological heritage. The archaeological heritage shall include structures, constructions, groups of buildings, developed sites, moveable objects, monuments of other kinds as well as their context, whether situated on land or under water." Каждая Сторона обязуется установить определенный кодекс поведения при проведении археологических работ и методов сохранения, независимо от того, осуществляются они на государственных или частных землях. Пункт i статьи 3 предусматривает, что каждая Сторона должна внедрить контролируемую процедуру археологической деятельности, предотвращающую "любые незаконные раскопки или изъятие элементов археологического наследия" и обеспечивающую научное управление археологическими ресурсами. Этот принцип подразумевает, что любое исследование должно оказываться минимальное воздействие, а обнаруженные находки должны быть надлежащим образом сохранены в процессе или после раскопок. Раскопки должны проводиться под контролем квалифицированных и специально уполномоченных лиц (см. ст. 3, пункт ii). Кроме того, "использование металлодетекторов и любого другого оборудования для обнаружения должно осуществляться только на основании специального предварительного разрешения" (см. ст. 3, пункт ii). В противном случае бесконтрольное использование такого оборудования приводит к разрушению археологического контекста из-за извлечения любых объектов, зарегистрированных прибором, без понимания их истинной природы.
Интегрированная сохранность археологического наследия
Статья 5 посвящена взаимосвязи между сохранением археологического наследия и проектами развития. Каждая Сторона соглашается привлекать археологов ко всем этапам планирования (ст. 5, п. i). Например, археологические объекты и их окружение должны рассматриваться при проведении оценки воздействия на окружающую среду (ст. 5, п. vi). Важно, чтобы "археологи, градостроители и региональные планировщики систематически консультировались друг с другом" (ст. 5, п. iii) для внесения изменений в планы развития, которые могут негативно повлиять на археологическое наследие (п. iv), что позволит сэкономить значительное количество времени и средств. Процесс консультаций может быть успешным только в том случае, если государства-участники предоставят доступ к "соответствующим обследованиям, инвентаризациям и картам археологических объектов" (ст. 7, п. i). Несмотря на то, что некоторые объекты археологического наследия будут повреждены, важные проекты все равно реализуются. В этом случае необходимо проводить спасательные раскопки, и государства должны обеспечить "достаточное время и ресурсы для проведения надлежащего научного исследования объекта" и публикации его результатов. Статья 6 пересмотренной Конвенции содержит подробную информацию об источниках финансирования археологических исследований и спасательной археологии. Если в ходе строительных работ обнаружены элементы археологического наследия, пункт vii статьи 5 предусматривает "консервацию in situ, когда это возможно". Однако в этом пункте не указано, каким образом это должно быть сделано. Одним из вариантов может быть проведение раскопок и консервация остатков с помощью грунта или специального покрытия, после чего строительство может быть продолжено над ними. Таким образом, объект и его элементы остаются частично или полностью доступными для будущих исследований.
Финансирование археологических исследований и сохранения
Государства обязаны организовывать общественную финансовую поддержку археологических исследований на местном, региональном или национальном уровне. Кроме того, и это важно, субъект, будь то государственный или частный, ответственный за соответствующий проект развития, обязан выделять финансирование любых необходимых связанных с ним археологических работ, таких как спасательные раскопки (ст. 6, п. ii). Это означает, что государственные или частные планы развития должны предусматривать в бюджете средства на проведение археологических исследований, полную фиксацию и публикацию результатов, аналогично тому, как это делается для оценки воздействия на окружающую среду (ст. 6, п. ii b).
Контроль за применением (пересмотренной) Конвенции
В качестве механизма обеспечения соблюдения Конвенции Комитет министров Совета Европы учредил комитет экспертов для контроля за реализацией и применением пересмотренной Конвенции (ст. 13). Этот контроль включает в себя: периодические доклады о состоянии политики охраны археологического наследия и реализации принципов Конвенции в государствах (ст. 13, п. i). Доклады и любые другие рекомендации или предложения направляются Комитету министров Совета Европы. Кроме того, комитет экспертов может предлагать меры по улучшению выполнения пересмотренной Конвенции посредством рекомендаций о внесении изменений, многосторонних мероприятий, информирования общественности (ст. 13, п. ii) или приглашений другим государствам присоединиться к данной Конвенции (ст. 13, п. iii).
